Terms of Use

1. About these terms

These Terms of Use ("Terms") are an agreement between you and ASM Professional Services, the Netherlands (KVK 42137630, VAT NL005526019B33), which operates MINDIDIA. By creating an account you confirm you have read and accept these Terms, our Privacy Policy and our Children's Privacy & Safety policy. If you do not agree, please do not use MINDIDIA.

2. The service

MINDIDIA is an online platform of learning games and puzzles for ages 4 to 70+, grouped by age. We may add, change or retire games and questions to improve the service, as long as the core of what you paid for stays available. MINDIDIA is for personal, non-commercial, family use.

3. Accounts and eligibility

• You must be at least 18 years old and legally able to enter a contract to create an account.
• Give accurate information and keep your password and parent PIN secret. You are responsible for activity on your account.
• One account = one adult profile plus up to two child profiles, all included in one subscription. Accounts may not be shared outside your household or resold.
• Tell us straight away at drmarfani5@gmail.com if you think your account has been misused.

4. Child profiles and parental responsibility

• You may only add a child profile for a child for whom you are the parent or legal guardian, and by doing so you give consent for their use of MINDIDIA.
• You are responsible for supervising your children's use, setting suitable play-time limits and play hours, and choosing the correct age group.
• Daily play time can be set from 15 minutes up to a maximum of 3 hours per profile. This maximum cannot be exceeded.

5. Free trial

New accounts receive a 3-day free trial of Premium. No payment card is needed and the trial does not turn into a paid subscription automatically. When the trial ends, games are locked until you choose a paid plan. One free trial per person and household.

6. Subscriptions, prices and payment

• Premium is available for 1, 3, 6 or 12 months. The base prices are €10, €25, €45 and €80. Prices in other currencies are shown on the Pricing page for your country.
• The price shown at checkout is the price you pay, including VAT or sales tax where applicable.
• Subscriptions renew automatically for the same period at the then-current price unless you cancel before the renewal date. We will remind you before a renewal of a plan of 3 months or longer.
• If we change prices, we tell you at least 30 days in advance. The new price applies from your next renewal, and you can cancel before then.
• Payments are handled by a secure third-party payment provider. If a payment fails, access may be paused until it is resolved.

7. Cancellation, right of withdrawal and refunds

• Cancel any time: cancellation stops the next renewal; you keep access until the end of the period already paid.
• 14-day right of withdrawal (EU/UK consumers): you may withdraw from a paid subscription within 14 days of purchase without giving a reason by emailing drmarfani5@gmail.com. Because the service starts immediately at your request, if you have already used Premium during those 14 days we refund the amount minus a proportional part for the days used.
• Outside the withdrawal period, paid periods are not refunded except where required by law or if the service was not provided as promised.
• Refunds are made to the original payment method within 14 days.

8. Acceptable use

You agree not to:

• Use cheats, bots, scripts or tricks to change scores, bypass play-time limits or access paid content.
• Copy, scrape, resell or republish games, questions or other content.
• Try to access other families' data, disrupt the service, or probe it for security weaknesses without our written permission (please report vulnerabilities to drmarfani5@gmail.com).
• Use MINDIDIA for any unlawful, harmful or commercial purpose.

9. Content and intellectual property

All games, questions, designs, the MINDIDIA name and logo belong to ASM Professional Services or its licensors and are protected by law. We give you a personal, non-transferable, revocable licence to use MINDIDIA under these Terms. Some content is created or checked with the help of automated tools and reviewed before publishing; if you find a mistake, please tell us.

10. Not medical or professional advice

MINDIDIA provides learning and cognitive engagement for enjoyment. It is not a medical device, treatment, diagnosis or educational qualification. Scores and levels are game results, not IQ or clinical measurements. We make no claim that MINDIDIA prevents, treats or cures any condition.

11. Availability

We aim to keep MINDIDIA available at all times but cannot guarantee it will be free of interruptions or errors. We may carry out maintenance, preferably at quiet times.

12. Suspension and termination

You may delete your account at any time by emailing drmarfani5@gmail.com. We may suspend or close an account that seriously or repeatedly breaks these Terms, or where required by law, after warning you where reasonable. If we close your account without a valid reason, we refund any unused paid period.

13. Liability

Nothing in these Terms limits your statutory rights as a consumer or our liability for intent, gross negligence, death or personal injury. Otherwise, to the extent allowed by law, our total liability to you is limited to the amount you paid us in the 12 months before the event, and we are not liable for indirect or consequential loss.

14. Changes to these terms

We may update these Terms, for example for new features or legal changes. For important changes we notify you at least 30 days in advance by email or in the app. If you do not agree, you may cancel before the change takes effect; continuing to use MINDIDIA afterwards means you accept the new Terms.

15. Complaints and disputes

Please contact us first at drmarfani5@gmail.com — we reply within 14 days. EU consumers may also use the European Commission's online dispute resolution information at ec.europa.eu/consumers/odr.

16. Governing law

These Terms are governed by Dutch law. Disputes go to the competent court in the Netherlands. If you are a consumer living elsewhere, you keep the protection of the mandatory laws of your country and may bring claims in your local courts.
